By downloading the MillionEars App, creating an account, or scheduling a call through our Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
MillionEars provides a platform to capture life stories. The Service allows a User (Account Holder) to schedule AI-driven telephone interviews with a Participant (e.g., a parent). The Service records these calls via the telephone network, transcribes them, and organizes them into a digital archive accessible via the App.
This is a critical section. Please read carefully.
You acknowledge that the Service operates by placing automated telephone calls to third parties designated by you (the "Participants"). By adding a Participant's phone number to the Service, you represent and warrant that:
You understand that all calls initiated by the Service will begin with a notification that the call is being recorded (e.g., "This call is being recorded to preserve your memory"). You agree not to use the Service to call any individual who has not consented to being recorded.

To the maximum extent permitted by law, MillionEars shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Service. Our total liability for any claim shall not exceed the amount paid by you to MillionEars in the past 12 months.
You agree to indemnify and hold harmless MillionEars, its officers, and employees from any claims, damages, or legal fees arising out of (a) your violation of these Terms, or (b) any claim that a call scheduled by you violated the rights (including privacy or publicity rights) of a Participant.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles.
